HRW: Release CJ and Cease attacks on Lawyers

By brazenly and unlawfully dismissing, detaining and humiliating the chief justice of the Supreme Court, President Musharraf has created a constitutional crisis at the judiciary’s expense.” - Ali Dayan Hasan, South Asia researcher for Human Rights Watch.

It seems clear now from recent events that Musharraf has sent an ominous message to the nation: That he, Pervaiz Musharraf is Pakistan. He is the military, the executive, the legislative and now the judiciary. With eight years under his belt, Zia ul Haq must be rolling in his grave as his protégé moves closer to breaking his eleven-year record of absolute military dictatorship. In an earlier post I mentioned that Law and Order from amongst his famous seven points has yet to be tackled, let alone restored but now it is apparent that he has no intention of bringing about any form of stablity in Pakistan. I have no idea how long he will be in power but with his current track record I can assure you that it wont be too long before he steps down voluntarily or involuntarily like Zia experienced. Below you will find an excerpt from a recent Human Rights Watch’s article. Not only were the lawyers unable to protest peacefully but they were violently beaten as well. This is pure hypocrisy and open disregard for human rights in Pakistan.
An injured lawyer during a protest in Lahore

On March 12, lawyers across Pakistan protested the arrest and detention of the chief justice by boycotting court proceedings and holding peaceful demonstrations. Police in the central Pakistani city of Lahore violently broke up one of the largest demonstrations ever by high court lawyers in Pakistan. Eyewitnesses told Human Rights Watch that protestors were peacefully marching down a main thoroughfare when police used batons to break up the procession. At least 20 lawyers were injured and some 50 have been arrested.

“The brutal assault on lawyers demonstrating for the chief justice raises bigger issues about the rule of law in Pakistan,” said Hasan. “The government needs to respond to this by taking appropriate action against those government officials responsible.”

Human Rights Watch said that the move to oust Justice Chaudhry points towards the Pakistani government’s determination to ensure control over the judiciary in the run up to elections due by the end of the year. Although Musharraf had appointed Justice Chaudhry in 2005, the judge has subsequently come to be regarded as a controversial figure who has attempted to assert judicial independence. Recently, he has taken up several human rights cases including initiating proceedings in cases involving enforced disappearances.

Research by Human Rights Watch indicates a pattern of “disappearances” in Pakistan involving US complicity in the abduction of individuals in the “global war on terror” and their interrogations by US law enforcement agents in illegal detention centers run by the Pakistani military’s Inter Services Intelligence (ISI) agency.  Lawyers’ protest pushed back by police with batons

Human Rights Watch called upon the United States and other governments to urge President Musharraf to promptly take meaningful steps to restore respect for the rule of law in Pakistan, including the release of the chief justice.

Aftermath of participation by general Zia uddin for himself has a lot of lessons for the present day participants. Participants from every walk of life, including brother judges, should be careful.

Well in Pakistan if you are honest and would like to do something for the betterment of it, than there are people like durrani and musharraf, who won’t let you do anything good.It is shame on all of us especially our politicians who are quiet on the awful treatment done on the chief justice.
I will ask musharraf to leave pakistan alone. We don’T want old people like you, not letting go the luxuries and denying the merit to other people

mr. mush. the best solution is to appoint another general as the chief justice of pakistan, but wait, this might not be safe enough for you as you cannot trust another general and for this reason you cannot take off your uniform; so very simple…..be kind to pakistan and take over as the chief justice of pakistan…..this will save all the headache as pakistan’s survival depends on you and your rogue cronies !!!!!

it is utterly shameful how Mr Mushraff has disgraced the law and order of his own country . I am not going to say who is right or who is wrong because i dont know where the truth lies. Yet as it seems on the face of it this is being done for personnal priorities only.I agree to Mr Iftikhar the session should take place publically and advocates should be allowed to have free access in support of Mr iftikhar. This is the 21st century and this incident has proven we havent gone too far at all!!! Absolutely disgraceful with the way they have house arrested his family and not allowing the children to go to school. My whole preception towards Mr Mushraff has changed. He has always been someone i had looked upto with pride. He didnt do this sensibly and didnot justify it hence i am of the opinion he is in the wrong and should be checked upon.

the current events will actually lead to removal of musharraf regime as a group of army fellows are already against musharraf so they will take these events as excuse of his removal. but i guess hesnt not only going to be removed from the govt but also from his life, as this is teh end of dictators in this age.

good luck in heavens general mushy

I am glad i dont live in a country where the Chief Justice Of the highest Court is not not safe. This is just disrespectful and misuse of powers. I think its time for the General to go or hide. I wish people of pakistan could realise that this time around and get rid of him.

  12. 12 Osman

Most, people I talked to recently said that he is as bad or worse than the current leadership. People seem to have lost faith in the revolution that the media and his legal team were promising.

I think we should be more careful before declaring people as heroes.

The CJ Mr. Iftikhar is an IDIOT!!

This person instead of teaching us to have faith in the judiciary is hell bent to make sure we all understand that only the street power is the way to get justice.

He should be tried for the loss of life and property which occurred only because of his visit to Karachi.

Mr Iftikhar, honest to God shame on you - you are responsible for a major historical debacle.

    Shahbaz Azmi,

    I agree with you.

This CJ has exploited the whole nation in the name of Justice. Using street power, he pressureized SC to give a decision in his favor. He did nothing less worst than our “rulers” who pressurized judiciary in past to get favorable decisions.

In my opnion, he did as much disgrace to judiciary as much Musharaf did.
